Welcome to Gharlo.pk (`Gharlo.pk`, `we`, `our`, or `us`). By accessing the Gharlo.pk website and mobile application(s) and using the Platform(s) (collectively, `Platform``), you are agreeing to abide by these Terms & Conditions (`Terms).

Accessing or using the Platform, creation or listing of property and otherwise use of our services constitutes acceptance of these Terms. If you don`t agree to this Terms, you should not use or access the Platform.

Accessing or using the Platform means that you agree to:

• You have read and fully understood these Terms and agree to abide by them.
• You agree to abide by all provisions herein, at all times on the Platform.
• You acknowledge that you have the legal and authority to enter into a binding agreement under the applicable laws.
• You agree to abide by all laws and regulations of the Islamic Republic of Pakistan applicable to you in your use of the Platform.

For the purposes of these Terms:

• Platform means the Gharlo.pk website, mobile applications and any services offered by Gharlo.pk.
• User means any person, business or other entity using or accessing the Platform in any way.
• Listing means any advertisement, post or content relating to a property that is published on the Platform.
• Property Owner means any person or organization that asserts a legal interest or control in selling a property on the Platform.
• Agent means any person who is employed by or designated by a property owner or client to act on behalf of that owner or client.
• Content means any text, image, video, document, map, floor plan or other content uploaded or shared on the Platform.

To use the Platform, the following conditions must be fulfilled:

• To access and use the Platform, you must be at least 18 years of age.
• You must have the legal capacity and authority to enter into binding agreements.
• It is your responsibility to give accurate, complete and truthful information when registering.
• You are not permitted to have been previously suspended, banned or restricted from using the Platform.

Gharlo.pk is not obliged to accept access by any user or to continue providing access to any account not complying with these eligibility requirements.

By creating an Account on the Platform, you agree to the following:

• You agree to register for your account with accurate and truthful information.
• You agree to keep your account`s information updated at all times.
• You agree to keep your log on and password confidential and in a secure environment.
• You agree to promptly inform Gharlo.pk if you suspect any unauthorized access to your account.

All activities that take place on your account are your responsibility.

By using the Platform, you agree to the following responsibilities:

• You agree to use the Platform for lawful activities.
• You will be truthful, complete and accurate in all your communications.
• Respect Other Users Rights, Privacy and Dignity.
• You agree to behave and act professionally and respectfully at all times.
• You agree to abide by all laws and regulations of Pakistan.
• You agree to be solely responsible for any content and information that you post on the Platform.

Users can upload listings of properties that can contain the following:

• Users are able to add more detail to the property description.
• Users are allowed to upload images of the property.
• Users can post videos of the property.
• Users are allowed to submit floor plans and layouts.
• Users can add maps, locations.
• Users can set the price of the property.
• When communicating with users, they can provide contact information, as per.
• Users can submit any additional documents pertaining to the property.
• The user agrees that he or she has the legal right to place the listing.

The users agree that their listings will not contain:

• Users are not allowed to post false or incorrect information.
• No false or misleading statements.
• Users may not advertise duplicate or repeated advertisements.
• Fraudulent or scam related offers shall not be published by Users.
• Offensive or inappropriate language is not to be used by Users.
• Users should not encourage hate speech or discrimination.
• Illegal content shall not be uploaded by Users.
• Users may not infringe upon any copyright or intellectual property rights.
• Spam and irrelevant content is not allowed to be posted by Users.
• NO upload of malware or harmful software is to be made by Users.
• Users shall not make inaccurate statements about the prices of properties.
• No user shall pretend to be the owner of any property.

Gharlo.pk guarantees the end user that the inclusion of any listing on this site is at their sole discretion and can be reviewed, modified, rejected, suspended or deleted at any time at Gharlo.pk sole discretion.

• Users must ensure that all of the information in their property listings is accurate, complete, legal and timely, such as ownership, pricing details, descriptions, images, documents, etc.
• Gharlo.pk is not responsible for or guarantees the correctness, completeness or accuracy of any listing.

• The Platform is intended to bring buyers and sellers together to purchase, sell, and offer properties for lease.
• All negotiations, agreements, payment, inspections and transactions occur between the parties involved.
• Unless explicitly stated, Gharlo.pk is not involved in and cannot be held liable for any transaction of property.

Gharlo.pk is an online marketplace and:

• The properties listed are not owned by gharlo.pk.
• Gharlo.pk is not a real estate broker or agent.
• Gharlo.pk is not involved in the sale or purchase of property.
• Gharlo.pk is not a buyer/seller.

No transaction is guaranteed to be successful with Gharlo.pk.

• Gharlo.pk does not check or confirm the following:
• Gharlo.pk does not verify ownership documents of properties.
• Gharlo.pk will not verify No Objection Certificates (NOCs).
• No records of mutation or land revenue are verified by Gharlo.pk.
• Gharlo.pk does not check the documents of property ownership.
• Gharlo.pk does not check legal title papers.
• Gharlo.pk does not verify government approvals.
• gharlo.pk is not responsible for the verification of tax records and tax liabilities.
• Encumbrances and legal issues are not verified by Gharlo.pk.
• Gharlo.pk cannot verify any legal status of any property.
• Users are strongly recommended to confirm the information relating to the properties independently of any decision making.
• Gharlo.pk is not involved in verifying sale agreements or contracts.

• All of the information about the property on the Platform is given by users and third parties.
• Any verification and/or moderation undertaken by Gharlo.pk is limited and not a legal verification or validation of any property.
• Users are strongly advised to obtain independent legal, monetary and technical advice prior to making any decision concerning property.

Communication can take place via:

• Users can use email to communicate.
• Users are allowed to communicate by phone calls.
• Users are allowed to communicate through WhatsApp.
• Users are free to use contact forms on the Platform.
• If allowed, Users may send messages to each other using built-in messaging tools.
• Users must be solely responsible for any communications they make via the Platform.
• Harassment, abuse, threats, fraud or any unlawful communication is prohibited by Users.

• Gharlo.pk owns or holds the license for all content on the Platform, such as design, coding, logos, trademarks, graphics, text and software.
• No part of this website can be copied, reproduced, distributed or modified without the prior written permission of Gharlo.pk.

• Users are the owner of the content they upload to the Platform.
• Users upload content to Gharlo.pk, thereby granting Gharlo.pk a non-exclusive, worldwide and royalty free license to use, display and reproduce, distribute and promote the content for the purposes of its operations and marketing.
• All Users confirm that they have all necessary rights and permissions to upload the content they submit.

• Featured Listings may be purchased to afford Users greater visibility.
• Users are able to buy premium advertising services.
• Users can register on promotional/marketing packages.
• Subscription services may be available in the future for Users.
• All prices, taxes and payment terms will be clearly stated prior to purchase.
• Failure to make payment may lead to suspension or cancellation of the service.

• Generally, once a service is completed, payment made is not refundable.
• Refunds will only be given when required by law or when billing errors are made.
• Gharlo.pk may accept or decline refunds as it sees fit.

• All advertisements are to be accurate and truthful.
• Advertisements shall be in accordance with all of Pakistan`s laws.
• Advertisements should not infringe on the rights of others.
• No advertisements can be misleading or false.
• Gharlo.pk reserves the right to terminate or reject advertisement at any time.

• Services are integrated into the Platform, including Google Maps.
• Analytics tools like Google Analytics may be used by The Platform.
• Communication tools like WhatsApp may be used by the The Platform.
• Platform may utilise third party payment gateways.
• The Platform may contain links to social media sites.

Gharlo.pk does not guarantee the contents or policies of services of a third party.

Your use of the Platform is also subject to the Gharlo.pk Privacy Policy, which details how your personal information is gathered, utilized and secured.

• No one is allowed to make or post false listings.
• No user shall commit identity theft or impersonation.
• Users shall not upload any forged or false documents.
• Users shall not engage in any money laundering activities.
• Users must not misrepresent properties or services.
• No Users may carry out phishing or scams.
• Users are not to be involved in any financial solicitation of any kind unless they are authorized to do so.
• Financial Fraud is prohibited.
• Users are not allowed to conduct any illegal activity using the Platform.
• Gharlo.pk can report any suspected fraud to relevant authorities as required.

• Users must not violate any applicable laws while using the Platform.
• It is the user`s responsibility to not upload viruses or malicious software.
• Users are not allowed to try to access the platform without permission.
• Users are not permitted to cause interference or disruption of Platform operations.
• Users are prohibited from collecting or harvesting without permission.
• No using fake or misleading accounts.
• Users are not allowed to post false or duplicate listings.
• No impersonation of a person or organisation is allowed by Users.
• Users are not to violate intellectual property rights.
• No user is allowed to use the Platform for illegal purposes.

Gharlo.pk reserves the right to suspend, restrict or permanently close any account and/or listing, with or without notice, for any reason that it deems appropriate if it believes that a user has violated the terms of these Terms, the laws of the territory in which it operates, or the integrity of the Platform.

To the greatest extent allowable by law, Gharlo.pk shall have no liability for any direct, indirect, incidental, consequential, special or punitive damages arising from:

• Property disputes
• Fraud by third parties
• Inaccurate listings
• Failed transactions
• Payment disputes
• Property defects
• Title disputes
• Loss of profits
• Business interruption
• Data loss
• Website downtime

Users agree that the purchase of property is done at their own risk.

You hold Gharlo.pk, its directors, officers, employees, affiliates and partners harmless from any claim, liability, loss, damage, cost or expense (including reasonable legal costs) incurred as a result of:

• Your breach of these Terms.
• Your misuse of the Platform.
• Your breach of applicable laws.
• The illegal use of another party`s rights.
• All content uploaded or submitted.

Gharlo.pk will not be liable for any failure or delay due to factors outside of its reasonable control such as:

• Natural disasters
• Floods
• Earthquakes
• Fires
• Pandemics
• Government actions
• Internet outages
• Cyberattacks
• Power failures
• Labor disputes
• Telecommunications failures

• All of these Terms are to be subject to and interpreted by the law of the Islamic Republic of Pakistan.
• All claims and controversy arising in connection with these Terms or their usage of the Platform will be remanded to the competent courts of Pakistan only.

Users are advised to try to resolve the issue amicably with Gharlo.pk before starting legal action. In the event of any dispute that cannot be settled by discussions either party is entitled to seek remedies under the relevant laws of Pakistan.

• These Terms may be updated at any time by Gharlo.pk.
• New terms will be made available on the Platform with new Effective Date. After such publication, continued use of the Platform is deemed to be an acceptance of the updated Terms.

The Terms & Conditions shall apply to the use of the Gharlo.pk Platform and shall not be deemed to be legal, financial or investment advice. Users are urged to obtain independent professional advice before entering into any transaction relating to a property. Gharlo.pk does not guarantee the legality, ownership or condition or value of any property advertised on the Platform.
